Director I do apologise for how long it has taken for a complete report of the legal cases that I have been working on to be filed however I have one case that after the given months of inactivity I believe should have been filed to your Office for review.  Attached is the personnel file and disciplinary results for one Ellia Prem Ezri that underwent a Captains Mast due to dereliction of duty which resulted in the loss of life, and failure to remove self from duty due to emotional compromise.

2409: ellia prem was promoted to lieutenant JG when she showed promise on tactical during a true way incursion she came up with a plan to destroy a true way dreadnaught by detonating a modified torpedo to cause a pules wave inside a near by asteroid belt in doing so the asteroid belt become the weapon to destroy the dreadnaught an 3 of her escorts.



2412: ellia was Requested a transfur to a hestia class ship when she hurd about its consturcting knowing the kowlae and experance she could gain from the new class of ship. she was luckly accepted and transfurd to the uss Atles under the command of captain malko bejal ezri. as chief tactical officer and was promoted to full Lieutant


2415: ellia's ship the USS Atles was on the front line during the year of hell after mounths of fighting and retreting the crew of the deadauls found them selves in the battle for earth. the deadauls took hevey damage and losses inculding the captain ellia took chardge of the ship when the XO was hurt shortly after. it came as a shock when the icoans called a ceas fire and retrated. sadly the captain was killed ellia was the only trill on bored capbale of beaing joined and accpted to take the simbiot. she was promoted to Lieutenat commadn and given command of the Atles she showed her self capable of commanding a ship under extream stress and is now curntly awating reasignemt she hopes to be reasigned to the 26th fleet."


2416: the USS Atles is transferred toThe 26th fleet how ever early on to there new assignment the Atles was destroyed by a pirate ship ellia fell unwell due to stress and loss of her command she received a reprimand on top of beaing newly joined she was sent back to trill for profeshanal help were she received and passed her philological testing after 5 mounths of hard work got the help that she needed and joined the 146th fleet seaking a new assignment she was given a temporally rank of commander on the USS Athana to assess her capability's of retuning to command and for duty's as a Starfleet officer. she assested in the battle for starbase 146 from the terren empire that had taken it over. she later than went on leave and became reacquainted with her family and friends of the 26h fleet sparking her relationship with captain Jason scott. it made her think of her opthions and applied to try retransfur to the fleet knowing she may well never see a ship command agen but in doing so would and will be closer to her friends she holds dear.

1. On Stardate 93664.7, while in command of the Federation Starship Atlas, you were engaged by a rogue Klingon Bird of Prey and your vessel was critically damaged, and deemed beyond repair by the Starfleet Corps of Engineers. While in command of this vessel, you made several critical errors in judgment not only around effective courses of action that may have saved your vessel, but also your own objective ability to command it according to Starfleet regulations. In failing to use your vessel’s superior tactical abilities, including potentially decisive systems such as the Multi Vector Assault Module, you jeopardized your ship and the lives of its crew, requiring you to eject its warp core, which further crippled your vessel. The record shows that thirteen officers died as a result of your inaction. I am therefore electing to punish you under the provisions of Article 92 of the Starfleet Code of Conduct.

 

2. You are hereby reprimanded. Your actions have brought into question your abilities as an officer in Starfleet, and demonstrate severely compromised personal judgment that is not befitting the commanding officer of a starship. It is noted for the record that your decisions were compromised by a combination of psychological factors, including your recent joining with a Trill symbiont, and the loss of a family member. It is nonetheless held that it is the reasonable responsibility of an officer to be capable of identifying such stresses, and when considering the ultimate ramifications, your decision to remain in such a high-pressure position of command constitutes willful negligence.

 

3. I strongly recommend you reflect upon your decisions. Your future career in Starfleet depends upon your willingness to adjust your personal attitudes.

 

4. You will acknowledge receipt of this reprimand below. You are entitled to attach a written statement by right of reply, along with any other supporting documents that will be attached to this reprimand in your permanent file.

Your Commanding Officer has elected in this instance to convene an Admiral's Mast to hear the charges and make a ruling based on evidence gathered in the course of this investigation. You are entitled to legal representation at the Admiral's Mast. You are advised to seek legal counsel and not to speak about this matter without them present. Should you need personal counselling, medical facilities are available. Your security clearances are revoked to a level appropriate for an officer awaiting criminal charges being heard.

Re: Initial Atlas damage analysis and data recovery

Admiral my Alpha team has begun an in depth profile of the damage suffered by the USS Atlas during the recent incident. While data recovery and damage analysis is ongoing there are three initial points I would like to bring to your attention.

1. I believe I know what caused the majority of the damage to the Atlas and I do not think it was the enemy ship attacking her. As you know a Tholian Web was deployed against the Atlas and I believe that the Atlas shields interphased with the Tholian Web causing V'tar-Hultz Feedback.

In essence VH Feedback drains increasing power from the ship's Warp Core to the shields which are in a state of constant failure due to being interphased with the filament of the web. This in turn causes damage to the Dililthium Crystal matrix. The Warp Core tries to produce more power to counteract this effect which, again, causes more damage to the matrix. In short order this will cause the Warp Core to become unstable. This, I believe, is why the Atlas ejected her Warp Core to prevent a Warp Core rupture that would have destroyed the ship.

Doing so saved the ship, but cracked the ablative armor of the Atlas like an eggshell and scrammed her phaser banks and other systems. At this point even outdated weapon systems are capable of doing tremendous damage in a short period of time.

Filament interphase causing a V'tar-Hultz Feedback loop is a rare situation but it has happened before. To counteract it the ship shields have to be brought completely down and then restarted. Leaving the shields up and simply trying to pump more power into the system will have catastrophic results. All ship Captains in the 26th fleet should become aware of this phenomenon.

2. It may be possible to rebuild the Atlas more rapidly then I first estimated. During the Iconian War the Engineering Department used an ad hoc emergency system to quickly repair major hull damage. The ship is towed outside of Praetorian base altogether where repair crews have greater freedom of movement. The remnants of the ships outer hull is stripped away and replaced by sectional hull plating which can be installed far more rapidly. While this is not the standard construction technique for Starfleet we had great success during the war using this process. It would also allow us the freedom to remove damaged systems whole sale so to speak and swap in new systems.

I estimate the Atlas recovery and rebuild time can be greatly reduced if we use this process. It would require a significant amount of EVA work and I would need to detail my Alpha and Beta dry dock teams. This will still leave me with four heavy repair teams for the phase modulator shield upgrade program, which I strongly advise continue at high priority given the theft of the Quantum Torpedoes from the Atlas. It should also prove useful against future encounters with a Tholian Web.

3. If my hypothesis of the V'tar-Hultz Feedback syndrome is correct then it would explain the discrepancies between the damage Commander Ezri reported and the damage that our survey discovered. In that scenario damage would have accumulated so rapidly it would have been very difficult for a Captain to be aware of it.

I will update you as further progress is made in the data recovery and damage analysis Admiral.

Several days ago, the Lieutenant Commander suffered a level one concussion, along with several fractured rib bones and first degree burns. The former and latter injuries were handled by Lieutenant Commander Hartman, who used prior knowledge of rudimentary medical techniques to accomplish this. The treatment of Lieutenant Commander Ezri's fractured bones were handled by myself and Nurse Delvoue. This was initially hindered by the transfer of Miss Ezri from Sickbay Alpha to Sickbay Beta, but was summarily handled with relative ease. She was then kept within Sickbay Beta to be observed in order to ensure no further problems occurred. After one day of observation she was deemed physically healthy.

However, psychologically, there are concerns. The Lieutenant Commander has refused needed sleep and nutrition during her tenure within Sickbay Beta as a result of a multitude of personal events within a narrow time frame, as well as a result of the destruction of the USS Atlas. After a brief conversation with the Lieutenant Commander, she had expressed that Lieutenant Commander Caelan Hartman and Decurion Vriha t'Rylov should make no attempt to speak with her unless regarding professional matters. They have been informed of request and have complied fully.

As such from personal observations, and after deliberation with Lieutenant Commander Ezri, I am placing her on official medical leave effective immediately until such time she has found herself capable of resuming her duties fully without personal compromise. Additionally to this, I am refraining from registering her out of the Patient roster for the time being, but will give permission for Miss Ezri to be present on the Promenade during times of her choosing so as long as she is accompanied by a member of the Medical Department, or with someone who has received permission directly from myself.

Until new developments have been made, I express that she is not fit to stand before a mast at the current time, despite the Lieutenant Commander expressing her determination to participate in this case to her fullest capacity.

As requested here is my description of Lt.Cmdr Ezri's mental state following the news of her father's passing.

In the shortest amount of words I would describe her condition as devastated.
She had invited me to the Atlas' readyroom to keep her company and and for conversation whilst she was working on paperwork but the moment she received and read the message informing of her of her father's death she instantly fell silent, almost into a catatonic state.

Her first response afterwards was to break down crying and to physically latch onto me when I approached which she did not release until Decurion t'Rylov arrived together with Lt.Cmdr Hartman after I had informed her of Lt.Cmdr Ezri's condition over comms.


Over the following days I kept contact with Lt.Cmdr Ezri and talked to her, during which her mental state seemed to stabilize somewhat but not completely.

To my knowledge Lt.Cmdr Ezri had not sought out or received counseling to help resolve the matter but I never asked her about it so I could be incorrect..


In my personal opinion I must admit I believe it to have been unwise for Lt.Cmdr Ezri to remain on active duty until both the matters of her father's death and the ritual of zhian'tara had been resolved.

I am writing this letter to be included with the formal evidence being presented about Lieutenant Commander Ezri's mental state during the time of the recent incident.

She and I spoke in Torg's. During that time we exchanged stories of our past, and she informed me about her father passing away. She kept a professional demeanor and sense of duty, but was obviously shaken and upset by his death. From what I was informed, her father was the reason she had wanted to further her career in Starfleet, and he was a man with whom she had the utmost respect.

Another fact I should point out is that she also shared with me the circumstances of her becoming a joined Trill. Many under-prepared young Trill became hosts over the past few wars due to injuries sustained in the line of duty, and Commander Ezri was no exception. She was joined because there was no other host around for which the symbiont could be transferred. Under normal circumstances a Trill would go through years of training and preparations to be able to handle this type of trauma and loss of self-identity. Unfortunately, Ezri was not able to do that. It is this fact that I believe she may not have had her full faculties about her at the time of the accident.

I'd like to state for the record that a joined Trill may never experience any abnormal symptoms which would normally procure their ability to command, however still slip into an altered state if not properly trained in the ways of coping with so many past lives.

In any case, I do know that the stress of losing her father, as well as other personal matters she was dealing with, combined with the dread and horrible sense of responsibility for those 13 lives, caused her to collapse while I was speaking with her. This should be a testament to the true duty she holds as a starship captain.

I'm filling this report as a Character profile for Lieutenant Commander Ellia Prim Ezri in regards involving the loss of her ship and thirteen crew members.

When I first met the commander she seemed to be your average Lieutenant Commander recovering from the Iconian war. Shaken by the lost of her Captain from the battle above Earth, and having a new symbiont transferred into her I can only imagine how troubling and traumatizing this may be.

During the simulation attack on SB381, Commander Ezri broke down into tears. Her father had a heart attack and was transferred to a hospital and was currently in stable condition. I questioned if she'd be able to make sound decisions and command her vessel. She assured me she would be fine and went onto the mission without incident.

I was unaware of her fathers death, and if I would have known about that I'd again unsure she'd be able to perform her duties as any other officer in charge. But at the time of the operation she apparently seemed to be capable officer.

It is in my professional stand point, I believe that the event's around Lt. Cmdr. Ezri should have been focused on more thoroughly to ensure she received the proper treatment for her new joining with a symbiont, possible PTSD from loosing her Captain in the Battle over Earth, and these recent events involving the loss of her crew, command, and what I am told a close lover. While I can not argue against the loss of the ship, or the loss of thirteen crew members, but what I ask is instead of taking this officers life and destroying it further to a point where she could never recover.

I purpose that the following actions be considered by command:

  1. Issue what punishments command sees just for loss of the U.S.S. Atlas
  2. Remove Lt. Cmdr. Ezri from active duty
  3. Begin the appropriate recovery steps to help rebuild a broken officer.


These are my professional opinions and you may take them as you will.

Medical Evaluation


Evaluation Date: 93083.96 (31 Jan 2416)

LTCDR Ezri was mentally and emotionally unfit for duty at the time of the incident. While it is likely she would have been reasonably able to handle a routine mission, she was in no way psychologically fit to command under combat or other high-stress conditions. As such, under no circumstances should the accused have been involved in the mission during which the damage to the USS Atlas and loss of several officers occurred. Under high-stress combat conditions, LTCDR Ezri suffered a breakdown due to both her memories of a previous combat experience and the multiple psychological stressors she had experienced between the end of the Iconian War and the incident in question.

However, the reporting officer believes, based on psychological evaluation as well as review of medical records, that the question of whether LTCDR Ezri is responsible for not relieving herself of command due to her mental and emotional inability to perform her duties also needs to be addressed. It is the professional medical opinion of the reporting officer that, while LTCDR Ezri was indeed neither fit for command nor otherwise capable of fulfilling her duties at the time of the incident, her mental and emotional impairment also rendered her incapable of making the decision on her own that she should be relieved of duty. Her impaired state made her dependent on the discernment of those around her, and with no external input to the contrary, LTCDR Ezri continued to attempt to fulfill her duties despite the mental and emotional issues which she was experiencing.

Specifically:

No reservations or limitations were noted by Starfleet Command before, during or after LTCDR Ezri's transfer to Task Force Avalon nor were there any formal recommendations for 26th's Counseling Departments to perform an evaluation to determine her fitness for duty.

Despite working closely with the accused on a daily basis, at no time did the XO or CMO of the USS Atlas report concerns about their commanding officer to the proper authorities nor did they report concerns to LTCDR Ezri directly.

LTCDR Ezri had spoken both personally and/or professionally with no fewer than two members of 381's Medical Department before the incident. At no time prior to the incident with the USS Atlas was LTCDR Ezri informed she may not be fit for command and should relieve herself of duty. There were also no formal recommendations for 381 or TFA's Counseling Department to perform an evaluation of the accused to determine her fitness for duty.

- On 3 Jan. 2416, LTCDR Ezri submitted a request for counseling stating that she had been encouraged by Dr. Hannah to seek assistance for the physical, mental and emotional issues which she, by LTCDR Ezri's own statements, openly shared with Dr. Hannah. There is no corresponding report from Dr. Hannah indicating concern for the accused's abilities to perform her duties, recommendations she be removed from command or request for Counseling to perform an evaluation.

- On 8 Jan. 2416, Dr. Aelae, 381's Chief Medical Officer, personally counseled LTCDR Ezri over the accused's difficulties with her sudden joining - a situation which had caused significant difficulty for the accused due to her lack of either preparation or desire for being joined with a Symbiont. The only formal report of this treatment was a note in the fleet's appointment management system which notes the accused was treated by Dr. Aelae on the date stated above. There is no report from this session indicating concern for the accused's abilities to perform her duties, recommendations she be removed from command or request for Counseling to perform an evaluation. The only follow-up was another appointment scheduled for three weeks from the date of initial treatment.


Note: This is not to implicate 381's Medical Department in negligence as that is outside the scope of this inquiry. It is possible LTCDR Ezri did not show the full depth of her mental and emotional issues at the time she was treated by both of the above officers. However, it is relevant to this inquiry that at no time did either of the aforementioned officers formally express concerns for LTCDR Ezri's ability to perform her duties either to her or her commanding officers.

In addition, the reporting officer feels he would be remiss if he did not also point out LTCDR Ezri's lack of command experience. Being able to evaluate your mental and emotional status in regards to being fit for command is as much a skill to be learned as any other command ability. It is reasonable to expect that LTCDR Ezri's inexperience, combined with the psychological issues she was facing and the lack of external input, left her ill-prepared to be able to correctly judge her fitness for command at the time of the incident.

I attest the above is true to the best of my knowledge and experience.

RE: Atlas MVAM Status.

Admiral an ongoing analysis of the Atlas indicates that during the incident in question that the MVAM system was operational.

I will try to keep this from becoming too technical but it comes down to operational status subroutines.

Every .002 seconds the computer checks to see if MVAM is operational by running a subroutine for every system connected to MVAM. Basically they are a go/no go check. A simple Boolean system if you will. If MVAM is non operational then it triggers a certain subroutine, one for each system, and if it is operational then it triggers another subroutine, again one for each system.

If any system reports a no go, while the rest of the systems are reporting a go it triggers yet another subroutine to investigate the cause and indicate to the crew there is a problem. Likewise if a system reports a go while the rest are reporting a no go.

I have full reports from five systems and partial reports from three other systems that show a go indicator for the MVAM with no triggering of the warning subroutine. There is no sign of outside malicious code, such as a virus that might have indicated MVAM was operational while it was actually off. Therefore I can say with a high degree of confidence that MVAM was operational during the time of the attack right up until the Warp Core was ejected and the computer scrammed from the power surge.

I will continue to refine this data but I expect any further information to confirm the operational status of the MVAC system.
